| Privacy Policy iStreaming Networks takes your privacy very serious. This Privacy Policy describes how we use and do not use information provided to us by our clients who have opened a hosting account with us, and the steps we take to protect it. This Privacy Policy only applies to information collected online. Visitors to the site only have an IP address in our server log which is used only for traffic statistics by our system administrator. Information We Collect from Our Clients When you open a hosting account with iStreaming Networks, we ask for your name, address, phone number, email address and other personal information. For purposes of billing, you will need to provide your credit card type, number, expiration date and billing address for the card. How We Use This Information We use the contact information you provide us with to establish our service for you. We use payment information for payment processing purposes only. We create and maintain other information such as customer account status, choice of services and customer logs in the normal course of providing a service. We will not disclose customer personal and account information unless we have reason to believe that disclosing such information is necessary to identify, make contact with or bring legal action against someone who may be causing harm or interfering with the rights or property of iStreaming Networks, our customers, or others, or where iStreaming Networks has good belief that the law requires such disclosure. iStreaming Networks will not, except for reasons stated below, disclose to third parties the contents of any electronic mail or other electronic communications that iStreaming Networks stores or transmits for its customers. The circumstances under which iStreaming Networks will disclose such electronic customer communications are when: 1. It is necessary to protect the legitimate interests of iStreaming Networks and its customers 2. It is required to cooperate with interception orders, warrants or other legal processes that iStreaming Networks determines in its sole discretion to be valid and enforceable 3. It is necessary to provide to a law enforcement agency when the contents are inadvertently obtained by iStreaming Networks and appear to appertain to the commission of a crime. iStreaming Networks disclaims any intention to censor, edit or engage in ongoing review or surveillance of communications stored on or transmitted through its facilities by customers or others. iStreaming Networks will, however, review, delete or block access to communications that may harm iStreaming Networks, its customers or third parties. The grounds on which iStreaming Networks may take such action include, but are not limited to, actual or potential violations of iStreaming Network's Acceptable Use Policy. Information Security We use SSL (Secure Sockets Layer) with a 256 bit length encryption key to insure protection of your credit card information during transmission over the Internet. Your credit card information is only passed thru our secure network to our merchant processor for authorization. Only the last 4 digits of your credit card number is stored in our database for reference on your invoice. Email Addresses iStreaming Networks policy for selling, renting, or leasing your Email information is: NO SELLING, RENTING, OR LEASE OF EMAIL ADDRESSES Cookies Some sections of our site do use cookies to store session information. These cookies are set only when a client is logged into our Admin Panel and get discarded when he logs out. They are not used for tracking purposes. |
| Acceptable Use Policy Content All services provided by iStreaming Networks may be used for lawful purposes only. iStreaming Networks does not monitor, edit, censor, or take responsibility for client content from within the network controlled by iStreaming Networks except inasmuch to determine if violations of the AUP have occurred once a suspected violation has been brought to the attention of iStreaming Networks. Therefore, clients are solely responsible for the content and use of their service as provided by iStreaming Networks and should ensure that such use falls within the guidelines of the AUP. Child Pornography The use of iStreaming Networks services to store, post, display, transmit, advertise or otherwise make available child pornography is prohibited. iStreaming Networks is required by law, and will, notify law enforcement agencies when it becomes aware of the presence of child pornography on, or being transmitted through, its services. |
| Terms and Conditions Service Fees. All clients are billed on a monthly billing cycle starting from the day they sign up for the service. iStreaming Networks accepts credit card payments for the monthly recurring service fee if the fee is under $1,000. We also accept bank transfers as well. Clients who have elected to have pay per minute tracking will be invoiced an additional amount for the Revenue Share at the end of the monthly cycle. The Revenue Share must be paid no later then 10 days after receipt of invoice. Payment for the Revenue Share can be made either by credit card or bank transfer. Refund Policy Refunds will be provided in the same payment method of the original payment. There are no refunds offered or promised after 30 days. Refunds will be minus the actual bandwidth used. Any refund will automatically close your service account with iStreaming Networks. Cancellations Cancellations are automatic if your invoice is not paid within the payment due date window and no formal request is required but is appreciated. We do not prorate our service so no refund will be given for an account closure. Failure to pay any open invoice within 15 days of the invoice date will automatically cause the account to be disabled. We will retain your account information for one year after account closure so that you have the chance to re-activate your account if desired. Limitation of Liability TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT, AND UNDER NO THEORY OF LAW OR EQUITY, WILL iStreaming Networks' (INCLUDING, WITHOUT LIMITATION, iStreaming Networks EXECUTIVES, DIRECTORS, OFFICERS, ATTORNEYS, MANAGERS, EMPLOYEES, CONSULTANTS, CONTRACTORS, AGENTS, PARENT COMPANIES, SUBSIDIARIES, CO-SUBSIDIARIES WITH THE SAME PARENT COMPANY AS iStreaming Networks, AFFILIATES, THIRD-PARTY PROVIDERS, MERCHANTS, LICENSORS, OR THE LIKE) OR ANYONE ELSE INVOLVED IN CREATING, PRODUCING, OR DISTRIBUTING iStreaming Networks' SERVICES, BE LIABLE FOR ANY BUSINESS OR PERSONAL LOSS, REVENUES DECREASE, EXPENSES INCREASE, COSTS OF SUBSTITUTE PRODUCTS AND/OR iStreaming Networks' SERVICES, OR ANY OTHER LOSS OR DAMAGE WHATSOEVER, OR FOR ANY CONSEQUENTIAL, SPECIAL, INCIDENTAL, PUNITIVE OR INDIRECT DAMAGES OF ANY KIND ARISING OUT OF ANY USE OF, OR ANY INABILITY TO USE, ANY iStreaming Networks' SERVICES EVEN IF iStreaming Networks' HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. iStreaming Networks' TOTAL CUMULATIVE LIABILITY, IF ANY, TO CUSTOMER, OR ANY THIRD PARTY, FOR ANY AND ALL DAMAGES, RELATED TO THE TERMS OF USE OR iStreaming Networks' SERVICES, INCLUDING, WITHOUT LIMITATION, THOSE FROM ANY NEGLIGENCE, ANY ACT OR OMISSION BY iStreaming Networks OR iStreaming Networks' REPRESENTATIVES, OR UNDER ANY OTHER THEORY OF LAW OR EQUITY, WILL BE LIMITED TO, AND WILL NOT EXCEED, THE ACTUAL DOLLAR AMOUNT PAID BY THE CUSTOMER FOR THE SERVICES WHICH GAVE RISE TO SUCH DAMAGES, LOSSES AND CAUSES OF ACTIONS DURING THE 3-MONTH PERIOD PRIOR TO THE DATE THE DAMAGE OR LOSS OCCURRED OR THE CAUSE OF ACTION AROSE. Disclaimer iStreaming Networks' service is provided on an as is, as available basis without warranties of any kind, either express or implied, including, but not limited to, warranties of merchantability, fitness for a particular purpose or non-infringement. iStreaming Networks expressly disclaims any representation or warranty that the iStreaming Networks' service will be error-free, secure or uninterrupted. No oral advice or written information given by iStreaming Networks, its employees, licensors or the like, will create a warranty; nor may you rely on any such information or advice. iStreaming Networks and its partners and suppliers will not be liable for any cost or damage arising either directly or indirectly from any transaction or use of our service. Intellectual Property Customers will not, without iStreaming Networks' express written consent, copy, reproduce, republish, or otherwise use any material, in whole or in part, that is located on iStreaming Networks' Web site, and customers will not use any of iStreaming Networks' trademarks, service marks, copyrighted materials, software, or other intellectual property without iStreaming Networks' express written consent. Customers will not, in any way, misrepresent their relationship with iStreaming Networks, attempt to pass themselves off as iStreaming Networks, or claim that customers are iStreaming Networks. |
